Brown V. Louisiana Essay

During the 1960’s, many African-Americans believed that civil rights should become a national priority. Young civil rights activists brought their cause to the national stage and demanded the federal government assist them and help resolve the issues that plagued them. Many of them challenged segregation in the South by protesting at stores and schools that practiced segregation. Despite the efforts of these groups and Supreme Court rulings that ordered the desegregation of buses and bus stations, violence and prejudice against African-Americans in the South continued Meyer, F. S. , 1968). In the 1960’s many things were off limits to African-Americans. They weren’t revered as equals and suffered greatly because of it. There’s an unfamiliar case to most that took place in Louisiana that helped shaped the use of public facilities for all people. This case is known as Brown v. Louisiana. The Audubon Regional Library in Clinton, Louisiana, Parish of East Feliciana did not serve blacks. Blacks, at that time, were expected to use one of two bookmobiles. The red bookmobile served whites and the blue bookmobile served blacks. On March 7, 1964, ive young African-American males entered the adult reading room and one of the men, Brown, requested a book called, â€Å"The Story of the Negro,† by Arna Bontemps. The assistant librarian checked the card catalogue and discovered that the library did not have the book. She told Brown that she would request it from the state library and he could either have it mailed to his home address or he could pick it up from the bookmobile. After the men had been given the news about the book they sat down quietly. After the men failed to leave the library, the assistant librarian requested that they go. They did not. Brown sat down while the others stood nearby. The assistant librarian then went to the head librarian who requested them to leave as well. Again, they did not. A few moments later, the sheriff arrived and requested that they leave again, and again, they did not. The sheriff arrested them and charged them with the intention to provoke a breach of peace and failure to leave a public building when ordered to do so (Coates, R. , 2005). The five men were tried and found guilty. Brown was sentenced to pay $150 for court costs or spend 90 days in Jail. The four other men were sentenced to $35 for court costs or 15 days in ail. Under Louisiana law, the convictions weren’t appealable therefore; their requests for discretionary reviews were denied. The Supreme Court granted certiorari. A certiorari is an extraordinary privilege injunction granted in cases that otherwise would not be entitled to review. In writing for the majority, Justice Fortas first examined whether the protesters could be convicted for refusing to leave the library. He concluded that they could not since their protest was peaceful and blacks could not be denied access since whites were allowed inside as well. He reviewed the onduct of the men and felt that this had no merit either. The state argued that the men were proving their intent to disturb the peace and upset the librarian. Justice Fortas concluded that the arrest was a violation of the men’s First and Fourteenth Amendment rights that guarantee freedom of speech and assembly and the right to opposed this opinion and took to issue with the majoritys reasoning. He disagreed that the Constitution prohibits any state from making â€Å"sit-ins† or â€Å"stand-ups† in public libraries illegal. Second, Black argued that the previous breach of the peace cases in Louisiana differed from Brown v. Louisiana. Previously there had been several other situations where there were peaceful demonstrations over discriminatory practices. Garner v. Louisiana (1961) involved a sit-in at a lunch counter to protest service for whites only. In Taylor v. Louisiana (1962) blacks again protested the presence of bus depot that was for white customers only. In Coxv. Louisiana (1965) a man led a demonstration near the courthouse and Jail to protest the arrest of other demonstrations. Each of the protests, along with Brown v. Louisiana, was all orderly and peaceful and was over discriminatory practices that denied the protesters’ rights hat were guaranteed to them under the Constitution. Justice Black opposition was joined by three other Justices. They argued that the First Amendment did not guarantee to any person the right to use someone else’s property even that owned by the government and dedicated to other purposes. On Wednesday, February 23, 1966 the decision was made; 5 votes for Brown and 4 against him (Coates, R. , 2005). The young men won! The Court’s ruling in this case, along with the others, proved vital to the Civil Rights struggles and also to the Vietnam War protests that would follow. Indeed, without these rulings the 1960’s and early 1970’s may have been a completely different period in time, especially when it comes to the Civil Rights movement. In the last line of Justice Blacks opinion in Brown v. Louisiana he wrote: â€Å"The holding in this case today makes it more necessary than ever that we stop and look more closely at where we are going† (Meyer, F. S. , 1968). In conclusion, had it not been for demonstrations of this kind, and the Supreme Court granting certiorari there is a strong possibility that none of this would have ever taken place. Oftentimes, it is in a ime of pain and suffering that the Just shall prevail, and I believe this is no different. There is more work to do but with the Supreme Court being behind you, at least you know it’s not in vain.

Arangetram

The music began, the audience fell silent, and it was show time. I was about to give one of the most important performances of my life. For a Bharatanatyam dancer, an Arangetram is a graduation ceremony that marks the transition from novice to professional. From the age of seven, I have been taking classes in this Indian classical dance, and it had all led up to this day. When I made the decision to work towards my Arangetram, I knew that it would take years of single-minded commitment. The grueling preparatory classes tested my dedication and endurance. As I got closer to the day, the mental and physical demands continued to increase. Practices would last for hours on end, and I had to continue putting in the maximum amount of effort day after day. After two years of ongoing practice, the day of the Arangetram finally arrived. The curtains went up and I danced harder than I had ever danced before. All eyes were on me for three full hours. No matter how tired I got, I continued to do my best. All the long hours of practice really paid off. That day, I performed in front of over 300 people. While it was exhilarating, it also felt surreal because I couldn’t believe that something I had worked towards for the past ten years was over. Looking back, I learned many important things along the way. Throughout the Arangetram preparation process, I learned the importance of hard work and dedication. In the end, everything came together as I put on the best show of my life. This experience has taught me valuable life lessons about setting lofty goals and persevering to achieve them. I now have the confidence that when I set a goal, I will achieve it.

The film follows the novel plot very closely in many aspects of the book. The similarities found in the film and novel is character portrayals, key scenes and overall messages. The film accurately captures the essence of the novel. In both the film and the novel, Rita Hayworth and Shawshank Redemption, the characters are portrayed in a very similar manner. On the other hand, hope was the most prominent message portrayed in the novel and film. â€Å"†¦I hope† (King, 107) hope was found in many various parts of Rita Hayworth and Shawshank Redemption, such as, the hope to be free, hope to survive and so on. â€Å"Hope is a good thing, maybe the best of things, and no good thing ever dies. † Another theme that is very obvious in Rita Hayworth and Shawshank Redemption is crime. Crime is found all throughout the film and novel because the setting takes place in a prison. Tommy Williams came to Shawshank in 1965†¦ Cops caught him sneaking TV sets out the back door of a JC Penney. † Every crime that was committed in the novel and film stuck to the same details and explanation, making both the novel and film very similar. â€Å"I committed murder. I put a large insurance policy on my wife†¦ then I fixed the brakes of the Chevrolet coupe. † (King, 15) Given these points, the director of the movie included all of the same messages and themes that were in the novel. Furthermore, the film was so similar to the novel that most key scenes were word for word. One key scene, being Andy’s murder trial, seemed to be directly taken out of the novel. â€Å"Since I am innocent of this crime, I find it decidedly inconvenient that the gun was never found. † In this scene, the dialect is the same for both the novel and the film, for example, â€Å"It’s neither convenient nor inconvenient. Only the truth. † (King, 24) Equally important, Andy’s escape scene was captured similarly in the film when compared to the novel. â€Å"Geology is the study of pressure and time. That’s all it takes really†¦ pressure†¦ and time†¦That, and a big goddamn poster. Andy spent years on end working away at his escape hole in the novel and the film; Andy knew what it took because of his knowledge in geology. â€Å"Ripped the poster from the wall†¦ and revealed the gaping, crumbled hole in the concrete behind it. † (King, 87) Lastly, when Andy meets tommy, tommy realizes that Andy is innocent and he kn ows who actually committed the murders. This is another scene that plays out the same in both the novel and the film. â€Å"It’s my life. Don’t you understand? IT’S MY LIFE! † in the film Andy begs Warden Norton to understand his situation and pleads that he is innocent. He began refreshing Norton on the details of the crime he had been imprisoned for. Then he told the warden exactly what Tommy Williams had told him. † (King, 64-65) in the novel Andy hopes that Norton will listen to the information he has heard and that Norton will be understanding, but instead Norton shut him down. As shown above, the key scenes in the novel and film have the same details and context. In conclusion, the film Rita Hayworth and Shawshank Redemption by Steven King portrayed the novel in a very similar way. It does so by portraying the characters, key scenes and messages in similar ways in both the novel and film.

The Mathematical Mystery Behind Sudoku Mathematics Essay Puzzle games can be very enjoyable and is popular amongst kids as well as adults. Many of you may know the game Sudoku; where by the goal of the game is to fill in the remaining empty cells with each number from 1-9 appearing no more than once from each column, each row and each of the nine sub-grids. Sudoku is a type of logic-based numerical puzzle game that has a unique solution once completed. The most common form of a Sudoku is constructed as a 99 grid with nine 33 sub-grids and is primarily partially completed. Sudoku has become appealing among puzzle enthusiasts and involves complex thinking and practice. Available daily in newspapers, mobiles and many more, this addictive and brain-teasing puzzle game has become one of the most popular games to play since the time of the Rubiks cube. This dissertation discusses the mathematical side involved in Sudoku. There is no mathematics in actually solving a Sudoku but more of how it is used from a creators side. The 99 grid will be considered in the majority of the report; however a glimpse into other size grids will be discussed briefly also known as variants. Mathematicians have been questioning How many unique solutions are there in a Sudoku? Essentially meaning what are the possible ways of filling in an empty Sudoku grid so that each row, column and sub-grid contains the numbers 1 through 9. Your first thought of an answer may be a couple of thousands, but as you understand the concepts behind a Sudoku, you begin to grasp a whole new aspect. Combinatorics and permutation group theory are largely interwoven with analysing Sudoku. For that reason, I aim to explore these theories and understand how it applies to the methods of enumerating Sudoku grids. In particular I will be looking at Felgenhauer and Jarviss approach to enumerating all possible Sudoku grids where they employ several mathematical concepts. Furthermore I will uncover the importance of Latin squares and its use of constructing Sudokus. There are many constraints in regards to when are similar solutions considered different such as solutions of similar structure, symmetry etc. Preserving symmetries are known as relabeling symbols, band permutations, reflection, transposition and rotation. Burnsides Lemma theorem is one of their techniques in computing the number of essentially different solutions. Many difficult problems are of the type called nondeterministic-polynomial known as an NP-complete problem. This will direct me onto the debate on whether Sudoku is an NP-complete problem. Sudokus can take many forms and shapes. These are called Sudoku variants and consist of rectangular regions, Sudokus with a large region having no clues (numbers), an empty row, column or sub-grid and many more! Here I will research the logic behind irregular Sudokus as well as examining any occurring patterns or whether it has occurred by chance. 1.2 Latin squares and Sudoku Sudoku is also a special case of Latin squares. The Swiss mathematician, Leonhard Euler made many fundamental discoveries during 1782 including Latin squares. A Latin square is an N x N matrix where by a set of N characters are arranged such that each row and column contains one of each character. This is also in the case of a Sudoku, when complete, with an additional constraint that the nine sub-grids must hold the numbers 1-9. A reduction can be made to any Latin square by permuting the rows and columns. This arrangement is an aspect of combinatorics and is most commonly referred to as enumeration. Enumerative combinatorics is a classic area of Combinatorics and involves counting the number of infinite class of finite sets. Counting combinations and counting permutations are two of the most common forms. The number of valid Latin squares is known to be approximately 5.525 x 10 ²Ãƒ ¢Ã‚ Ã‚ ·. Write about Colbourns proof 1.3 Combinatorics and Permutation group theory Combinations and permutations have slightly different meaning. Combinations are the number of different ways of selecting n objects from a set but the order of events is not important. From a set of 3 objects, lets call these 1, 2 and 3. If for example I was asked to pick the number of ways of selecting 2 objects out of the 3, there would be three combinations 12, 23 and 13. 12 = 21 since the order of each pair is not important. A permutation on the other hand does consider the position. Therefore if I was to use the above example, there would be six permutations. A simpler way to calculate a larger set would be to use formula 1: Formula 1. = = Where is the combination formula, is the permutation formula, n is the total number of objects and r is the number to be arranged Both methods are one way of computing the number of possible Sudoku solutions and this will be looked at later in the report. Chapter 2 Enumerating possible Sudoku solutions 2.1 Distinct Sudoku solutions There are many approaches to enumerating possible Sudoku solutions. To enumerate every possible Sudoku solution, a Sudoku differs from another if they are not identical. Thus all solutions will be consider unless they are like for like. Felgenhauer and Jarvis was the first to enumerate the Sudoku grid solutions directly in 2005. There approach was to analyze the permutations of the top row used in valid solutions. Their knowledge of the complexity in computing the number of Latin squares has made them aware of how they should go about getting an answer with fewer computations. Hence by using relabeling this could shorten the number of counts. To make it easier, each sub-grid is given an abbreviation seen in figure 3. B1 B2 B3 B4 B5 B6 B7 B8 B9 Figure 1. To work out every possible way of arranging B1 on its own would essentially be computing the number of permutations of 9 symbols. There are 9! of filling in B1. B1 in standard form (Felgenhauer and Jarvis, 2006) Felgenhauer and Jarvis have found that B2 and B3 is the same as the transpose of B2 and B3. Therefore the number of ways of arranging B1, B2 and B3 and B1, B2 and B3 to a complete grid is equally the same. This means that computing one set of possibilities will cut down the number of solutions. Inevitably, there are few pairs of B2 and B3 that needs to be worked out and as well as using reduction the number of possibilities for the top band of a Sudoku grid is 9! x 2612736 = 948109639680. The next section involves brute force computation. As running through all 2612736 possibilities would be exceedingly tedious for B2 and B3, Felgenhauer and Jarvis attempts to identify configurations of the numbers in these blocks which give the same number of ways of completing to a full grid. This in return, will cut down the number possibilities. Permuting B2 and B3 in every way such that the result gives a unique solution will preserve the number of complete grids. This is the same for B5 and B6, and B8 and B9. However this changes B1 from its standard form, so an additional relabeling of B1 needs to be performed. Another approach to reducing the number of possibilities is to permute the columns in each block and permute the rows of any block. Reducing the number of possible ways by permuting. Lexicographical reduction Permutation reduction Column reduction As a result of these methods, Felgenhauer and Jarvis have found that there are approximately 6670903752021072936960 à ¢Ã¢â‚¬ °Ã‹â€  6.671 x 10 ²Ã‚ ¹ Sudoku solutions. In light of this result, there are fewer solutions than Latin squares due to the fact that there is that extra restriction of 9 sub-grids. That being said, there will be no shortage of Sudoku puzzles any time soon. Verification of this result has been confirmed by several other mathematicians Ed Russell to be more precise. 2.2 Essentially different Sudoku grids Whether symmetrical Sudoku grids are considered as two separate solutions is another method of enumerating the possible solutions. In this case, the only solutions are ones that are essentially different. Lets say two Sudoku grids are equivalent if one is a transformation of the other by applying any number of symmetries. If however, no such chain of symmetries can occur between two grids, it is essentially different. Two Sudoku grids are the same provided the first grid can be converted to the second by applying some sort of symmetry. When an object is subject to these operations, certain properties are preserved. An example would be if one performs symmetry on to a Sudoku grid and repeats this operation once more, the final transformation is itself symmetric. In addition a symmetrical object can be transformed back to its original state by another form of symmetry. Performing several symmetries on a Sudoku grid can also be achieved by grouping its neighbouring pair. So the first symmetry can be paired with the second or the second can be paired with the third and so on. The resulting transformation is nevertheless the same either way. From these properties, it is inevitable to say that the set of symmetries form a group of any Sudoku grid. A group is a set G if it satisfies the following properties: CLOSURE If f and g are elements of G, then f ·g is also an element of G. ASSOCIATIVITY If f, g, and h are elements of G, then f ·(g ·h)=(f ·g) ·h must satisfy. IDENTITY ELEMENT There is an element e in G such that g ·e=e ·g=g for all g in G. INVERSE For any element g of G, there is another element d of G such that g ·d=d ·g=e, where e is the identity element. (The element d = g-1.) The symmetry group is thus generated by the transformations of: re-labelling the nine digits, permuting the three stacks (3 vertical blocks of a Sudoku), permuting the three bands (3 horizontal blocks of a Sudoku), permuting the three columns within a stack, permuting the three rows within a band, and any reflection or rotation. Any two transformations can be merged to shape other elements and together they comprise of the symmetry group G. Given that any element of G can be mapped so that it takes one grid to another, we can say that the set of valid Sudoku grids has a finite number of elements. Thus G has finitely many symmetries. The association between symmetrical Sudoku grids are in fact an equivalence relation and satisfies the following three properties: for grids A, B and C in set G Reflexivity A = A Symmetry If A = B then B = A Transitivity If A = B and B = C then A = C Let A be any valid Sudoku grid, we must consider all the grids that are equivalent to a valid Sudoku grid A. To do this, we firstly have to group together grids that are essentially the same so that we can partition the set of grids. This will break the set of Sudoku grids into subsets, with groups that contain no relating elements within each other. The term subset can be called equivalence classes. This can also be referred to as X/G. In any equivalence class, there are elements that are equivalent to each other by symmetry. The total number of elements in X/G is equal to the number of essential Sudoku grids. To enumerate all essential Sudoku grids, we shall look at all the symmetries neglecting the re-labelling of the nine digits for the time being. The number of distinct symmetries founded by Russell and Jarvis (2006) is said to contain 3359232 (pg 4). In this finite group H, we need to find the average number of grids fixed by an element of H, up to re-labelling. Next we need to verify the number of fixed points of all elements in H. Russell and Jarvis have found that there are 275 classes of symmetries using a software package called GAP. It is interesting to note that some of the elements in H contain equivalent fixed grids. In other words, it is now easier to work out as each of the classes contains one symmetry. However a number of symmetries in H have no fixed points. Subsequently, it is not necessary to calculate the number of fixed grids for those that have no fixed points. That being said, there are only 27 out of 275 classes that contain fixed points, meaning fewer computation s. Rotman. J. J (1995) demonstrate that if X is a finite G-set and |X/G| is the number of G-orbits of X, then Formula 2 holds where, for gцG, X is the number of xцX fixed by g (pg 58-61). Using this notion, we have established that the number of valid Sudoku grids is of a finite set and X/G is the number of essentially different Sudoku grids, so we can obtain the number of essentially different Sudoku grids by using the Burnside Lemma Theorem. Formula 2. Burnside Lemma Theorem (Rotman, 1995) Burnside Lemma Theorem is a useful tool when dealing with symmetry with a set of countable objects. When used to enumerate the essentially different Sudoku grid, the set of equivalent grids form an orbit of the symmetric group. The number orbits are essentially the number of different grid solutions. This may sound slightly (ALOT) trickier to compute, nonetheless Russell and Jarvis have shown that the number of essentially different Sudoku grids is 5,472,730,538 with the implementation of Burnsides Lemma Theorem. Chapter 3 Nondeterministic polynomials 3.1 NP-complete and Sudoku Sudokus may relate to a variety of problems, in particularly, whether Sudoku is an NP-complete problem. It is known that NP-complete problems are one of the most complicated cases in NP, also referred to as nondeterministic-polynomial. Its rival, P problems relates to NP as both being in the same complexity class. Mathematicians have yet to solve whether NP-complete problems can be solved in polynomial time or more commonly whether P = NP. Consequently being one of the greatest unsolved mathematical problems. The majority of computer scientists believe that P à ¢Ã¢â‚¬ °Ã‚   NP, as a result would mean that NP-complete problems are significantly trickier to compute than to verify. Unfortunately, nobody has yet found an efficient algorithm, not even with the use of computers available today. A problem is said to be NP-complete when its solution can be proved in polynomial time. And if that problem can be solved in polynomial time, all problems in NP can be solved too. An interesting characteristic of NP-complete problems is that the time frame to solve the problem increases rapidly as the size of the problem gets larger. If that is the case and Sudokus are NP-complete, solving a Sudoku of higher order (say 17 ² x 17 ²) will become increasingly challenging algorithmically then the standard 3 ² x 3 ² version were talking trillions of years. It has been shown that Sudoku does belong to the category of NPC problems by Takayuki Yato of the Univeristy of Tokyo (2003). An exchange for the notation ASP-completeness (shorthand for Another solution problem), led the proof of NP-completeness of ASP. Their proof uses reduction in order to obtain the required polynomial-time ASP from the problem of Latin squares by Colbourn (1984) who has verified, the NP-completeness of ASP of Latin square completion Another accountable source by Provan states that, It is known that solving general-sized Sudoku puzzles is NP-hard, even for square grids with blocks consisting of the sets of rows and columns (Latin Squares) or for p2 x p2 grids with blocks consisting of rows, columns, and the p2 partitioned p x p subsquares. Mathematical programmes such as the 0-1 linear programming and the knapsack problems are also cases of NP-complete problems. A full list of other problems that are NP-complete can be found in Garey and Johnson (1979). Chapter 4 Sudoku Variants 4.1 Variation The classic form of a 99 Sudoku are polyominoes. There are other variations of Sudokus that can be applied to the rules of Sudoku. There are puzzles of the size 66 with 23 regions or a 1212 grid of 43 regions. More so, there are other fascinating Sudoku variants such as Greater than Sudoku. Chapter 5 Personal Critical Review The progress I have made during the duration of this project, have been fairly slow but surely getting there. Having said this on many occasions, I have still not conquered my time management skills! The project started very slow which meant I was behind schedule. Nevertheless my organisational skills have kept me on balance. The GANT chart has been of great help in doing so. What has kept me going throughout this project in particular would be self discipline and motivation. This project has proven that I am capable of working to my own initiative, but also well within a group; my time during the group project. Furthermore, my time on this project has definitely promoted a better mentality of my future ambitions. I have learnt that it is crucial to read a lot, as well as reading as broadly as I can. This in turn have aided in the running of my project. With other coursework deadlines, I made that a priority and had no time to meet with my supervisor. I understand that meeting with my supervisor is equally important because a supervisor is there to encourage and to advice on any difficult obstacles I may encounter. An area of interest to proof whether NP-complete problems can be solved in polynomial time, was left open as future work. This could be the next step of extending this report that little bit further. Chapter 6 Conclusion A challenging problem for further research is to proof whether NP-complete problems can be solved in polynomial time. This has yet to be solved and anyone who has a formal proof will be rewarded $1 million dollars by The Clay Mathematics Institute.

Lymphoma Lymphoma or lymphatic cancer is a very serious and life threatening disease. In this country there is an estimated 63,900 new cases, 7,100 of which are Hodgkin’s lymphoma as opposed to non-Hodgkin’s lymphoma. Since around the 70’s the occurrence of non-Hodgkin’s lymphoma has almost doubled while the occurrence of Hodgkin’s disease has declined. (Steen, 1993)   Ã‚  Ã‚  Ã‚  Ã‚   Lymphoma is the name given to a cancer that infects the lymphatic system. In a case of lymphoma the lymphatic system has cells that multiply and cannot be stopped. There are two main types of lymphoma, Hodgkin’s and non-Hodgkin’s. Non-Hodgkin’s lymphoma is called lymphoma and Hodgkin’s type lymphoma is called Hodgkin’s disease. Hodgkin’s disease is different from non-Hodgkin’s disease in that Hodgkin’s disease has a Reed-Sternberg cell present in the areas infected with the cancer. Hodgkin’s disease occurs mainly in people between 15 and 40 or over 55. Non-Hodgkin’s type cancer is much more common than Hodgkin’s disease. Non-Hodgkin’s lymphoma is a group of over 29 types of lymphoma. These are classified by the US National Cancer society as aggressive or fast multiplying or indolent, slow multiplying. Within this system, that consists of organs such as the spleen and tonsils, there are organs that destroy foreign agents, those organs are called lymph nodes. The lymphatic system works as follows; the bone marrow produces blood cells including white blood cells. White blood cells are the cells that find and destroy disease-causing agents. Both B and T cells change a great deal to defend the body from pathogen. It is while the B cells are transforming that cancers can infect them. Tuberculosis Tuberculosis is caused by Mycobacterium tuberculosis (M.TB.), has a unique cell wall, making it difficult to kill and stain. Three matjor components compose the cell wall: mycolic acids, cord factor, and Wax-D. M.TB. is also hard to culture and can only thrive in the body. It is an obligate aerobe and an acid-fast bacteria. Tuberculosis can be diagnosed through the Mantoux test and by staining methods such as the Ziel-Neelsen method. Chest x-rays are also used in the diagnosis process to detect any damage done to the lungs. Tuberculosis is caused by M.TB. This bacterium is hard to kill because of its cell wall, which is 60% lipid. M.TB. is also difficult to stain and culture (Todar, Kenneth paragraoh 14). Skin tests and microbiologic smears and cultures are the main methods used to diagnose TB, though the full diagnosis consists of many more tests. M.TB. is a rod-shaped bacterium related to the Actinomycetes. The rods are 2 to 4 um long and 0.2 to 0.5 um wide. This bacterium is an obligate aerobe, an organism that needs oxygen to survive. It is a tough bacterium that can withstand weak disinfectants and can survive in a dry state for weeks. M. TB. is a slow-growing bacterium that divides every 16 to 20 hours, which is extremely slow compared to other bacterium, which have division times measured in minutes (Wikipedia paragraph 1). Although M.TB. contains peptidoglycan in their cell wall, it is neither Gram-positive nor Gram-negative because it lacks the chemical characteristics of either. The Mycobacterium species is classified as acid-fast bacteria because it is virtually impermeable to certain dyes and stains, but once stained, the dye is permanent. The Ziehl-Neelsen method is one method used to stain Mycobac... ...ed as an acid-fast bacilli because of its impermeability to stains. The Mantoux skin test, Ziel-Neelsen method, BACTEC system, and the chest x-rays make up the most common methods used to diagnose tuberculosis. Communities and Urbanization Essay -- essays research papers

COMMUNITIES & URBANIZATION Introduction George Murdock once said that a community is one of the two truly universal units of society organization, the other one being family (Schaefer, 461). We are all part of a community, and in many cases, we are a part of multiple ones. In chapter 20 of our textbook, we are looking at communities and urbanization. It discusses urbanization and how communities originate. It also looks at the different types of communities. Communities are defined as â€Å"a spatial or political unit of social organization that gives people a sense of belonging† (Schaefer, 548). It can be based on a place of residence, such as a city, neighborhood, or a particular school district. It could also be based on common identity, such as gays, the homeless, or the deaf. Lets take a look at communities and urbanization through the functionalist perspective, the conflict perspective, and symbolic interaction. According to the functionalist perspective, communities are very much structured to maintain their stability as a society. When you look at such things as urban ecology, it is a prime example, because it looks at how different elements in urban areas contribute to stability (Schaefer, 464). According to the conflict perspective, communities are very much structured in a way that separates different communities by certain conflicts. You have the upper class of a community, and then you have the lower working class. You have black and Jews, and then you have the KKK. All these things cause different communities to be separated and structured to unify each different community. One very example of the conflict perspective in this chapter is new urban sociology. Symbolic interaction can be viewed many different ways according to communities. Anywhere from the upper class using very proper etiquette and high posture, to gays wearing a piercing only on their right ear. You also have your working class that may look older and more rigid than the officials and owners of companies who have not had to do a lot of manual work throughout their lives. The list can go on and on. All of these are ways that symbolic interaction helps to set up different communities. Conclusion In this chapter, we learned about how different communities were developed. We learned about preindustrial cities, industrial cities, and postindustrial cities. We learned the process of urbanization through the functionalist and conflict perspectives. We also learned about the many different types of communities that there are. Communities are found everywhere. No matter where you go, you will always find yourself in a community of some sort, and you will always belong to a community somewhere, whether it be residential or political, or both. Evolution or Ignorance of Education

Throughout recent history creationists and evolutionists have argued whether evolution should be a part of America's public education. Whether evolution is science fact, or science fiction. Evolution being a science based on statistics has some faults, although many concepts in science or math do. The process of learning about evolution is a necessary part of a well-rounded student's education due to the fact that it is a statistically proven science and removing it in turn revokes certain student's rights. In a student's academic career that a student is most likely at one time or another going to have to take a science class. Science, being the main topic of discussion in this class, should at one point include evolution, because that is what evolution is, a science. Although to truly understand evolution in its fullest context, one must not look to a dictionary, for dictionary definitions just are too vague. One of the most respected evolutionary biologists has defined biological evolution as follows: â€Å"In the broadest sense, evolution is merely change, and so is all-pervasive; galaxies, languages, and political systems all evolve. Biological evolution †¦ is change in the properties of populations of organisms that transcend the lifetime of a single individual. The ontogeny of an individual is not considered evolution; individual organisms do not evolve. The changes in populations that are considered evolutionary are those that are inheritable via the genetic material from one generation to the next. Biological evolution may be slight or substantial; it embraces everything from slight changes in the proportion of different alleles within a population (such as those determining blood types) to the successive alterations that led from the earliest protoorganism to snails, bees, giraffes, and dandelions. † – Douglas J. Whether it being living proof such as in Biology where one can observe cell division, mathematical proof such as in calculating air-resistance in Physics, or statistical proof as in all science experiments when a predicted result occurs again and again. All sciences have at least one of these qualities, including evolution. The proof of evolution's existence has been on this earth ever since life was formed from carbon based atom structures. Humans, however, have not been in existence long enough to observe properly the phenomena of evolution. Although by using the latest technology we can accurately observe the process of evolution as it occurred over time long ago and is still happening today. Charles Darwin, a British naturalist, made the first major step in classifying evolution during his studies in the Galapagos Archipelago in 1831 when he was only 22 years of age. Due to this he is credited with first forming a structured theory of evolution. During his studies in the Galapagos Archipelago he found a multitude of flora and fauna that had complete isolation from the rest of the world. One particular type of animal that he paid close attention to be a small bird called a Finch. This was thought as being simple at first, but as he traveled to the different islands he noticed many different species of finches. These finches probably descended from one type of ancestor and then, due to isolation and through chance, different climates and natural forces such as food availability and type, they evolved into many different types of finches. Some finches had different colorings, wingspan, and even beak style. In total he found thirteen different varieties of finches. Later on in Charles' life he formed many theories on the origins of man. This was directly related to his studies in the Galapagos Archipelago. In his book â€Å"Decent of Man† written in 1871 he declares why man had been so ignorant by denying evolution in the final parts of chapter one. â€Å"Thus we can understand how it has come to pass that man and all other vertebrate animals have been constructed on the same general model, why they pass through the same early stages of development, and why they retain certain rudiments in common. Consequently we ought rankly to admit their community of descent: to take any other view, is to admit that our own structure, and that of all the animals around us, is a mere snare laid to entrap our judgment. This conclusion is greatly strengthened, if we look to the members of the whole animal series, and consider the evidence derived from their affinities or classification, their geographical distribution and geological succession. It is only our natural prejudice, and that arrogance which made our forefathers declare that they were descended from demigods, which leads us to demur to this conclusion. But the time will before ong come, when it will be thought wonderful that naturalists, who were well acquainted with the comparative structure and development of man, and other mammals, should have believed that each was the work of a separate act of creation. † (Darwin) As seen in the above text, Charles Darwin explains how statistically man did evolve from a lower form of life. This is directly related to the finches due to that the same forces that caused them to evolve may have caused humans to evolve as well. Yet still some schools in America have tried banning the teaching of evolution in the classroom. Every student in a United States public school has a constitutional right to hear the whole story when it comes to evolution. It is called the first amendment in the Bill of Rights. According to the American Civil Liberties Union or ACLU, the authority on civil rights, states that every student has the right to a non-biased education (ACLU Urges†¦ ). In the Supreme Court decision Edwards v. Aguillard, 482 U. S. 578 (1987), the Court ruled that to compromise by omitting evolution and creationism from the science curriculum would â€Å"undermine the provision of a comprehensive scientific education. On this point, the law is very clear, and the Supreme Court put its foot down — the First Amendment forbids a state to alter its curriculum simply in order to defend a religious belief. That's an establishment of religion, and it's unconstitutional. (Edwards) So not only is removing evolution from the classroom unjustified, but it is against the law. Creationism has its place in the classroom as well as Evolutionism, although not the same classroom. Creationism belongs in a class like Theology or History of Religion. This is because creationism is the belief in the biblical account of the creation of the world. Biblical meaning the Bible, restricting it only to a group of religions. So-called â€Å"Creation Science† is not a science at all. Lately it has been more of a political movement than a science. Sure creationists may have facilities like the â€Å"Institute for Creation Research† (a church that does no scientific research at all) and the â€Å"Creation Research Society† (another church that also does no scientific research), but in the end there is not a shred of science in creation. Recently many science teachers in public schools have tried to work their way around teaching evolution by teaching a so called â€Å"intelligent design theory† (Washington State). This is just one of the many guises of creation science, and it does not change the fact that states and school districts may not adopt religious theories as standards in school curricula. Creationists will always exist, since ignorance will always exist, although evolution will always have a place in science curriculum. Creationists believe in creation because their masters have told them to believe in Creationism as a tool to their â€Å"salvation†. They do not care that evolution is an observed fact: they have â€Å"faith† that Creationism is true, and that's all they need. They consider facts and truth to be a hindrance to their ticket to Heaven. The teachings of these people should have no place, and will have no place in our children's science classrooms, only evolution and other proven sciences have the right to be present. Therefore, the process of learning about evolution is a necessary part of a well-rounded student's education due to the fact that it is a statistically proven science and removing it in turn revokes certain student's rights.

France †Change over Time Essay (French Revolution) Essay

*As the title indicates, this is a change/continuity AP essay written for World History class. Vaguely, the essay question was: Describe change and continuity in France from the mid-1700s to the mid-1800s.*Like many other European nations in the 1700’s, France experienced a dramatic shift of sentiments against the monarchy, nobility, and Catholic Church as the people, fired by rousing new Enlightenment ideals, began to question authority and emphasize the need for equality, liberty, and democracy. The social and political changes in France were best characterized by three different periods – the weak monarchy of King Louis XVI and the subsequent period of confusion after his removal from power, the reign of Napoleon Bonaparte and his downfall, and the new order brought about by the Congress of Vienna; central to these changes were Enlightenment influence, nationalism, and France’s relations with other countries. However, despite the great social upheavals of this time period, gender roles remained more or less unchanged and although women had begun to rouse the idea of women’s rights, little changed in the way that society viewed women because men still held economic power. France was the most advanced country of Europe in the 1700’s, home to many leading philosophers such as Voltaire and Montesquieu. Despite its prominence, it was experiencing domestic instability and civil unrest. The aloof King Louis XVI paid little attention to what was happening outside his opulent court and was unable to control the rebellions when they started cropping up. Goaded by Enlightenment ideas, the lower classes began to demand equality and liberty. When their demands were not met, they stormed the French prison Bastille on July 14, 1789 and the revolution was truly underway. The National Assembly became the dominant political power, taking away the feudal privileges of the First and Second Estates and establishing control over church lands. It created a limited constitutional monarchy, giving Legislative power to the Assembly. Wary of rebellions within their own borders, Austria and Prussia attempted to preserve absolute monarchy in Europe by quelling the French revolution. The Legislative Assembly responded by setting aside the Constitution of 1791, deposing the king, and creating a new governing body. A consequent Reign of Terror ensued during which the Jacobins, and later on Robespierre, gained power and instituted a period of  wide spread executions and radical policies. It was during this period that use of the guillotine became popular. Eventually, the Reign of Terror was overthrown and a moderate government under the Directory was installed. This period saw France change from an absolute monarchy to a period of radical rule then finally to a more moderate form of government. Throughout this, women played a key role in facilitating the spread of ideas by opening their salons to Enlightenment thinkers, creating an environment for new philosophies to form and proliferate. However, they had little direct power and were still seen as inferior to man, albeit new Enlightenment ideals of equality. The Directory chose talented military leader, Napoleon Bonaparte, to become general of the French army; he later moved on to become one of three counsels holding executive power. However, Napoleon’s coup d’etat would put all of France under his control and return France to an absolute monarchy. Napoleon’s reign achieved many Enlightenment ideals despite his Hobbes-like policies; he equalized taxation, repaired the corrupt government, struck a balance between state and church power, and created the Napoleonic Code. He managed to quell the Austrian threat although he did not succeed in Egypt. Napoleon turned away from the New World and sought, instead, to create French dominance in Europe, conquering many neighboring countries and establishing control over Spain and Portugal. Unfortunately, his three mistakes – the Continental System, the Peninsular War, and the invasion of Russia – eventually caused his downfall. The Fourth Coalition, comprised of Britain, Russia, Prussia, Sweden, and Austria, defeated Napoleon and exiled him to the island of Elba. Despite a brief attempt to regain control of France, called the Hundred Days, Napoleon would never again dominate France. During Napoleon’s reign, France saw the return of the absolute ruler. However, growing nationalism brought about Napoleon’s removal from power. This period is also marked by the continuity of woman’s role in France. Despite the tumultuous events of the time, women saw little change in their rights and status. Philosophers like Mary Wollstonecraft found little support for her ideas and France politics and society continued to be a male dominated arena. After Napoleon’s removal from power, the Congress of Vienna, comprised of Prussia, Russia, Austria, Britain, and France, met to forge peace. Using conservative polices, the map of Europe was redrawn to ensure the balance of power and monarchs were restored, created peace in Europe until 1853. However, the French revolution had flamed a support for nationalism as more conquered nations demanded autonomy; the majority of the rebellions were unsuccessful. France had a final revolution had removed the monarchy for good and established a democratic republic. France had finally made the transition from absolute monarchy to democracy. With this change came many social changes such as the end of serfdom in Western Europe and the decreased power of the nobility and the increased importance of wealth in determining power. Women continued to work for women’s rights, including suffrage, but were met with unenthusiastic responses. In fact, despite the radical political changes France had undergone, gender roles hardly changed at all, demonstrating the continuity of women’s status from the time of Louis XVI to after the Congress of Vienna. On a global scale, the basic trends of the French Revolution were very similar to those of the American Revolution. Both were flamed by Enlightenment thinkers advocating equality and liberty and democracy over monarchy and Church control. Both would encourage other rebellions later on – the American Revolutionary ideas would spread to Latin America while French Revolution sentiments would bring about revolts in Germany, Hungary, and other parts of Europe. Woman’s rights also remained rather static in both areas of the world; it would be several more years before women’s rights were considered seriously. The main difference, however, lay in the fact that while the US simply separated itself from Britain authority, France underwent the whole transformation, from absolute monarchy to democracy, despite the periods of unrest in between. The 1700’s was a period of great change in Europe, and France’s progression from absolute monarchy to democracy illustrates the movements of Enlightenment thinkers and the growth of nationalism and the new importance of domestic stability and a satisfied lower class. Three distinct time periods – Louis XVI’s rule and the Reign of Terror, Napoleon’s reign, and  Europe following the Congress of Vienna – illustrated this profound political change. Throughout the political change, however, was continuity in women’s rights and status. Gender roles remained largely the same. There were many parallels between the French Revolution and the American Revolution, depicting an international trend – the growing power of democratic governments. Corporate Social Responsibility and Business Law Essay

Introduction Our assigned topic deals with a phenomenon that has taken the corporate world by storm rather recently, particularly in Pakistan. It entails the dilemma that every corporation faces when they have to make decisions regarding the firm’s profitability and their corporation’s social responsibility. The term â€Å"corporate social responsibility† came into common use in the late 1960s and early 1970s after many multinational corporations formed the term stakeholder, meaning those on whom an organization’s activities have an impact. It was used to describe corporate owners beyond shareholders. The field of corporate social responsibility (CSR) has developed exponentially in the last decade. Nevertheless, there remains a lingering debate about the legitimacy and value of corporate reaction to CSR concerns. There are different views of the function of the firm in society and disagreement as to whether wealth maximization should be the sole goal of a corporation. An escalating number of shareholders, analysts, regulators, activists, labor unions, employees, community organizations, and news media are asking companies to be accountable for an ever-changing set of CSR issues. There is rising demand for transparency and growing expectations that corporations measure, report, and continuously improve their social, environmental, and economic performance. According to Business for Social Responsibility (BSR), corporate social responsibility is defined as â€Å"achieving commercial success in ways that honor ethical values and respect people, communities, and the natural environment.† Each company is at variance in how it implements corporate social responsibility, if it does so at all. The differences depend on such factors as any particular company’s size, the particular industry involved, the firm’s business culture, stakeholder demands, and how historically progressive the company is in engaging CSR. Some companies focus on a single area, which is regarded as the most important for them or where they have the highest impact or vulnerability—human rights or the environment, for example—while there are others who endeavor to incorporate CSR in each and every one facet of their operations. For successful execution, it is fundamental that the CSR principles are part of the corporations’ values and strategic planning, and that the management and employees, both are committed to them. Furthermore, it is important that the CSR strategy is aligned with the company’s specific corporate objectives and core competencies. As CSR comes into contact with many of the problems conventionally addressed by government, like human rights and community investing, there is strong censure that societal problems are best solved by freely elected government bodies as the resources of a corporation are poorly matched for addressing those social problems, and therefore, it is argued, they should not be misallocated. According to Friedman (1970), in a free society, â€Å"there is one and only one social responsibility of business—to use its resources and engage in activities designed to increase its profits so long as it stays within the rules of the game, which is to say, engages in open and free competition without deception or fraud.† The idea is that the state should address social problems, supported by the argument that an executive, by taking money and resources that would otherwise go to owners, employees, and costumers, and allocating them according to the will of the minority, and will fail to serve the interests of her or his principal. In this way, the executive imposes a tax and spends the proceeds for â€Å"social† purposes, which is insupportable, since she or he has neither the skills nor the jurisdiction to do so. On the other hand, there are many demands by others for corporate adoption of the CSR principles. Although the government is chiefly responsible for addressing those issues, the contribution of private firms can be substantial. There is also the argument of the shifting balance of power. According to the Organization of Economic Co-operation and Development (OECD), of the 100 largest global economies, as indicated by their respective GDP, 51 of them are US corporations, and only 49 are nation states. So economic supremacy has shifted to the corporations; they, therefore, should have an increasing role in and accountability for addressing social problems. For example, the government sets the regulations and the minimum standards for the workplace, but a company can further improve the work environment and the quality of living of its employees. A firm cannot stay oblivious to the problems of the environment in which it functions. The poverty of a nation state’s citizens, political unrest, and the exhaustion of natural resources can have destructive effects for a corporation. For example, resources that are inputs in the production process and which, at the foundation of the industrial revolution, were plentiful are now scarce, polluted, or diminishing in many regions of the entire planet. As one would expect, this imposes an extra cost to the corporations and may force them to reposition or to cease operations. From one perspective, companies may be poorly equipped to address some of the social or environmental problems, but from another perspective, no matter how poorly equipped, companies may still be best positioned to improve the problems. Undoubtedly, adopting the CSR principles involves costs. These costs might be short term in nature or continuous outflows. They may involve the purchase of new environmentally friendly equipment, the change of management structures, or the implementation of stricter quality controls. Since being socially responsible involves incurring costs, it should generate benefits as well in order to be a sustainable business practice. A corporation could not continue a policy that constantly generates negative cash flows. The shareholders invest their money in a corporation, expecting the highest possible risk adjusted return. Therefore, being socially responsible should have bottom-line benefits in order to be sustainable. Socially responsible corporate performance can be associated with a series of benefits with the final outcome. But in a lot of cases, it seems that the time frame of the costs and benefits can be out of alignment—the costs are in the near future, whereas the benefits are not often realized until long periods of time have lapsed. Nevertheless, many benefits can be identified. Firstly, socially responsible companies have enhanced brand image and reputation. Consumers are often attracted towards brands and companies with good reputations in CSR related issues. Therefore, a corporation’s brand equity is automatically enhanced. A company regarded as socially responsible can also benefit from its reputation within the business community by having increased ability to attract capital and trading partners. However, reputation is hard to quantify and measure; it is even harder to measure how much it increases a company’s value. But since companies have developed methods to measure the benefits of their advertisement campaigns, similar methods can and should be able to be applied in the case of corporate reputation. Socially responsible companies also have less risk of negative rare events. Furthermore, companies that adopt the CSR principles are more transparent and have less risk of bribery and corruption. In addition, they may execute stricter and, thus, more costly quality and environmental controls, but they run less risk of having to bear in mind defective product lines and pay heavy fines for excessive polluting. They also have less risk of negative social events which damage their reputation and cost millions of dollars in information and advertising campaigns. The scandals about child–labor and sweatshops that affect the clothing industry are two fine examples. Thus, socially responsible businesses should have more stable earnings growth and less downside volatility. Since companies that adopt the CSR principles carry less risk, when valuing those companies, a lower discount rate should be used. In the company valuation this lower tail risk should be taken into account. There are also other cases in which doing what is good and responsible converges with doing the best for the particular business. Some CSR initiatives can dramatically reduce operating costs. For example, reducing packaging material or planning the optimum route for delivery trucks not only reduces the environmental impact of a company’s operation, but it also reduces the cost. The process of adopting the CSR principles induces executives to reconsider their business practices and to seek more efficient ways of operating. Companies perceived to have a strong CSR commitment often have an improved ability to attract and to retain employees (Turban & Greening 1997), which leads to reduced turnover, recruitment, and training costs. Employees, too, often evaluate their companies CSR performance to determine if their personal values conflict with those of the businesses at which they work. There are many known cases in which employees were asked, under pressure of their supervisors, to overlook written or moral laws in order to achieve higher profits. These practices create a culture of fear in the workplace and harm the employees’ trust, loyalty, and commitment to the company. Companies that improve working conditions and labor practices also experience increased productivity and reduced error rates. Regular controls in the production facilities throughout the world ensure that all the employees work under good conditions and earn living wages. These practices are costly, but the increased productivity of the workers and improved quality of the products generate positive cash flows that cover the associated costs. Thus, firms may actually benefit from socially responsible actions in terms of employee morale and productivity (Moskowitz, 1972). Literature review CSP is a global concept that encompasses those of Corporate Social Responsibility and Corporate Social Responsiveness. It provides a coherent framework to explore business-society relationships by looking at the social impact of corporations with business criteria of performance measurement, such as quality, efficacy, effectiveness, innovation (Carroll, 1991; Wood, 1991). The challenge for corporate social responsibility (CSR) in developing countries is framed by a vision that was distilled in 2000 into the Millennium Development Goals—‘a world with less poverty, hunger and disease, greater survival prospects for mothers and their infants, better educated children, equal opportunities for women, and a healthier environment’ (UN, 2006: 3). The penetration of the social realm into corporate strategy has gathered momentum in the last years. The movement for CSR has â€Å"won the battle of ideas† (Crook 2005). By now, most well managed companies have adopted th e practices and certifications mandatory in their industries, having gone through what Zadek (2004) calls the â€Å"defensive† and the â€Å"compliance† stages of CSR. Managing the social and environmental footprint of economic activity is generally accepted as part of the cost of doing business. But much remains to be done. If companies are to move their CSR activities from satisfying behavior and take their commitment to society and the environment to the next level, they will need to rethink their current approaches to CSR, tapping into the creativity of every individual. CSE, like all entrepreneurship, is not about managing existing operations or CSR programs; it is about creating disruptive change in the pursuit of new opportunities. It combines the willingness and desire to create joint economic and social value with the entrepreneurial redesign, systems development, and action necessary to carry it out. Accelerated organizational transformation faces a host of obstacles well-documented in the change management literature. Some people argue that media pressures the corporate managers and directors to behave in ways that are â€Å"socially ac ceptable†. Sometimes this coincides with shareholders’ value maximization, others not (Zinagales, 2002). Although there are several contested notions of what CSR should be and how it should work, there is some agreement upon what it broadly entails. A number of concepts and issues are subsumed under the heading of CSR, including human rights, environmental responsibility, diversity management, sustainability, and philanthropy (Amaeshi & Adi, 2006), meaning that it is a complex area with an interdisciplinary focus. It is generally agreed that CSR involves corporations voluntarily exceeding their legal duties to take account of social, economic and environmental impacts of their operations. Consideration of the social, economic and political context demonstrates how CSR forms part of a wider strategic direction being taken internationally with regard to market relations and the pursuit of a range of objectives and goals. The context is in part provided by concerns about the numerous examples of irresponsible behavior on the part of corporations, ranging from colluding with oppressive regimes and in the overthrowing of governments (Alston, 2005) to issues relating to working conditions and the impact of unethical marketing practices (Richter, 2001). Such examples have demonstrated the need for the worst excesses of business to be curbed. The globalised economy is understood to raise important issues for businesses and governments due to changes in patterns of production and consumption. In particular it is noted that the manufacturing of goods is â€Å"highly mobile† (Cassell, 2001:263) and that supply chains are often dispersed in various countries, creating difficulties in terms of legislation and regulation. Moreover, economic globalization presents challenges to the ability of states to protect people’s rights (Cassell, 2001). The notion of corporate social responsibility is part of the ‘third way’ (Gond & Matten, 2007), where the role of the state is now to provide â€Å"steering for the promotion of social development and social justice† (Giddens, 2001: 6). There is increased involvement of the private sector in traditionally statutory provision through privatization and public/private partnerships (Meehan, 2003). Economic policies have created a need for markets and business to self-regulate in order to continue to pursue an international free market economy, but also to ensure sustainability of economic, human and other resources, and of the environment. CSR is seen as a solution to these problems of regulation. The private sector is increasingly seen as a key player in the achievement of many national and international strategic objectives for governments, which is also enabled by CSR. Methodology To gather information, we used secondary research as our main source of information. Various academic journals and internet sources were pursued to cater to the important aspects of the given topic. Moreover, since we thoroughly researched this topic, personal opinions were formed and using those and logic, we justified our opinions accordingly. How can business persons act in an ethically and socially responsible manner and at the same time make profits? Suppose clear-cutting is profitable and legal, but is nonetheless regarded as environmentally irresponsible under prevailing social norms. Can management of a timber corporation decline to clear-cut its timberland even though that sacrifices profits? One might be tempted to evade the question by claiming that being environmentally responsible is profitable in the long run, either because it preserves the forest for future harvesting or because it maintains a public goodwill that aids future sales. But suppose, in an incautious moment, management admits that the present value of those future profits from not clear cutting cannot hope to match the large current profits that clear-cutting would produce. Or, more realistically, suppose a takeover bid by a firm known to clear-cut establishes precisely that proposition by offering far more than the stock price that reflects the current stream of profits. Can management reject the profitable takeover bid on the grounds that it will lead to socially undesirable clear-cutting? The answers to these questions will challenge the canonical law and economics account on corporate social responsibility, which goes something like this. Unless modified by statute, traditional fiduciary duties require corporate managers to further the interests of shareholders, and thus require them to maximize corporate profits subject to the obligation to comply with independent legal constraints. Ethics and social responsibility are very important values in business ventures. This is particularly essential in decision making process. Ethical conscience reminds business persons to make trustworthy and profitable business decisions. Likewise, the social responsibility component requires business persons to make entrepreneurial decisions that can enhance benefits and repelling harms to the stakeholders. The canonical law and economics view holds that corporate managers do and should have a duty to profit-maximize because such conduct is socially efficient given that general legal sanctions do or can redress any harm that corporate or non-corporate businesses inflict on others. If certain conduct imposes excessive harm on others or merits taxation, then an independent law should regulate and impose liability or taxes whether or not the actor is a corporation, and if the conduct does not impose any impermissible harm or merit taxation, then the most socially desirable thing for corporations to do is maximize profits. Other stakeholders could either legally protect themselves by contract with the corporation or have their legal protection provided by judicial gap-filling of such contracts. Part of what makes this account canonical is that it helps define the boundaries of the corporate law field. It leaves corporate law scholars free to ignore issues about any effects the corporation may have on the external world as topics best addressed by other legal fields, and to focus on more tractable models about which corporate rules would maximize shareholder value.
